Terms of Service

These Terms of Service ("Terms") govern your use of Kong Metrics, operated by Egos Technologies Limited ("we," "us," or "our"), including the website at kongmetrics.com and the application at app.kongmetrics.com (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Service Description

Kong Metrics is a search analytics platform that connects to your Google Search Console and Google Analytics 4 accounts to provide data visualization, insights, and optimization recommendations. The Service processes your search analytics data to generate dashboards, reports, and automated recommendations.

2. Account Registration

To use the Service, you must create an account using Google OAuth. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You must provide accurate and complete information during registration.

You must be at least 16 years old to use the Service. By creating an account, you represent that you meet this age requirement.

3. Plans and Pricing

Kong Metrics offers Free, Pro, and Agency plans with varying features and limits. Plan details, pricing, and feature availability are described on our Pricing page and may change with notice.

• Free Plan: Available at no cost with limited features and data retention
• Paid Plans: Billed monthly or annually as selected at checkout
• Upgrades: Take effect immediately with prorated billing
• Downgrades: Take effect at the end of the current billing period

4. Billing and Payments

All payments are processed by Paddle, our Merchant of Record. Paddle handles billing, invoicing, sales tax, and VAT compliance. By subscribing to a paid plan, you agree to Paddle's Terms of Service.

Paid plans include a 14-day free trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will begin and you will be billed according to your selected plan and billing cycle.

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. Refunds are available within the applicable refund window as described in our Refund Policy.

5. Your Data

You retain all ownership rights to your data. We do not claim ownership of your search analytics data, account content, or any information you provide through the Service.

You grant us a limited, non-exclusive license to access, process, and store your data solely to provide and improve the Service. We will not use your data for any other purpose without your explicit consent.

You may export your data at any time using the export features available in the Service. Upon account deletion, your data will be permanently deleted within 30 days, except where retention is required by law.

6. Google API Services

The Service uses Google API Services to access your Google Search Console and Google Analytics data. Your use of data obtained through Google APIs is subject to the Google API Services User Data Policy, including the Limited Use requirements.

We access only the data necessary to provide the Service and do not use Google user data for advertising or for any purpose other than providing and improving the Service.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to the Service or its related systems
• Interfere with or disrupt the Service or servers connected to the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated tools (bots, scrapers) to access the Service except through our official API
• Resell or redistribute the Service without our written permission
• Use the Service to compete directly with Kong Metrics

8. Intellectual Property

The Service, including its design, features, code, documentation, and branding, is owned by Kong Metrics and protected by intellectual property laws. Nothing in these Terms grants you rights to our trademarks, logos, or branding.

9. Limitation of Liability

To the maximum extent permitted by law, Kong Metrics shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or business opportunities, regardless of the cause of action.

Our total aggregate liability for any claims arising under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim. The Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied.

We do not guarantee that the Service will be uninterrupted, error-free, or that any data or analytics provided will be completely accurate. You are responsible for verifying any insights or recommendations before taking action.

10. Indemnification

You agree to indemnify and hold Kong Metrics harmless from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, violation of these Terms, or infringement of any third party's rights.

11. Termination

You may terminate your account at any time by contacting us or using the account deletion option in your settings. We may suspend or terminate your account if you violate these Terms, with notice where practicable.

Upon termination, your right to use the Service ceases immediately. We will delete your data within 30 days of account termination, except where retention is required by law.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey.
